Privacy Policy

This notice explains why I need to collect your personal data and what I do with it.

 

The information you share with me is confidential and not shared with any third party unless I receive your explicit consent, or where I am required to do so for legal or safeguarding reasons.

 

Your information is safeguarded, stored and processed in line with UK GDPR, the Data Protection Act 2018, and the Data Use and Access Act (DUAA).

 

When you supply your personal details to me, when we communicate by email, or when I take notes in session, this information is stored and processed for three reasons in line with data protection law:

  • I need to collect personal information in order to provide you with the best possible service. Your requesting therapy and my agreement to provide that care constitutes, in law, an unwritten contract.

  • I have a legitimate interest in collecting this information, because without it I couldn’t practise professionally and safely.

  • I keep records of your contact information because I may need to contact you to confirm or cancel appointments; this is also a legitimate interest.

The DUAA introduces a new lawful basis called Recognised Legitimate Interests. This applies to certain public‑interest purposes. I do not rely on this basis in my counselling practice, but I am required to inform you of its existence.

 

I do not use your information for marketing, profiling, or any commercial purpose. I also do not use any automated decision‑making systems; all decisions are made by a qualified human practitioner.

 

I have a professional obligation to keep your records for 6 years after your last appointment. After this time, I will securely delete all information kept about you.

 

You have a right to see what personal data of yours I hold. When responding to a request, I am required to carry out a reasonable and proportionate search, and I will respond within one month.

 

If you have a concern that I am mishandling your data in any way, you have the right to complain. Please raise your concern with me first, as I would hope to resolve any issues directly. You can contact me at carthewcounselling@gmail.com

I do not use your data for scientific research or any secondary data use.

 

If you visit my website, essential cookies may be used to make the site function. Some anonymous, aggregate analytics may also be used, as permitted under the DUAA. Any cookies that identify you personally will only be used with your consent.
